Regulations regarding accommodation

Terms and Conditions for Accommodation Contracts

Scope of application

(Article 1) 1. Accommodation contracts and related contracts entered into by our hotel with guests shall be as stipulated in these terms and conditions, and matters not stipulated in these terms and conditions shall be governed by laws and regulations or generally established customs.
2. If the Hotel accepts a special agreement to the extent that it does not violate laws and customs, that special agreement shall take precedence, regardless of the provisions of the preceding paragraph.

(Article 1)1.Contracts for Accommeodation and related agreements to be entered into between this Hotel and the guest to be accommodated shall be subject to these Terms and Conditions. And any parrticulars are not provided for herein shall be governed by laws and regulations and /or generally accepted practices.
2. In the case the Hotel has entered into a special and regulations and generally accept practices, notwithstanding the preceding Paragraph, contact insofar as such special contact does not violate laws the special contact shall take precedence.

Application for Accommodation Contract, etc.

(Article 2) 1. A person who wishes to apply for an accommodation contract with this hotel must provide the following information to the hotel.
(1) Guest name and contact information
(2) Accommodation date and estimated time of arrival
(3) Accommodation charges (as a general rule, according to the basic accommodation charges in attached table 1)
(4) Other matters deemed necessary by the hotel
2. If a guest requests to continue staying beyond the accommodation date set forth in item 2 of the preceding paragraph during their stay, the hotel will treat the request as having been applied for a new accommodation contract at the time the request is made.

(Article 2) 1. A Guest who intends to make an application for an Accommodation Contract with the Hotel shall notify the Hotel of the following particulars.
(1) Name of the Guest(s) and number of guests
(2) Date of accommodation and estimated time of arrival
(3) Accommodation Charges(based, in principle,on the Basic Accommodat Charges listed in the attached Table No.1)
(4) Other particulars deemed necessary by the Hotel.
2. In the case the Guest requests, during his stay, extention of the accommodation beyond the date in subparagraph (2) of the preceding paragraph, it shall be regarded as an application for a new Accommodation Contract at the time such request is made.

Conclusion of Accommodation Contracts, etc.

(Article 3) 1. The accommodation contract shall be concluded when the hotel's application in the preceding article is accepted. However, this does not apply if the hotel proves that it has not consented.
2. When an accommodation contract is concluded pursuant to the provisions of the preceding paragraph, the application fee specified by the hotel, which is limited to the basic accommodation fee for the period of stay (3 days if it exceeds 3 months), must be paid by the date specified by the hotel.
3. The application fee will first be applied to the final accommodation fee payable by the guest, and will be returned at the time of payment of the fee to which the provisions of Articles 6 and 17 apply.
4. If the application fee set forth in Paragraph 2 is not paid by the date specified by the Hotel pursuant to the provisions of the same Paragraph, the Accommodation Contract shall become invalid. However, this only applies if the hotel notifies the guest of this when specifying the due date for payment of the application deposit.

(Article 3) 1. A Contract for Accommodation shall be deemed to have been concluded when the Hotel has duly accepted the applications as stipulated in the preceding article. However, the same shall not apply when it has been proved what the Hotel has not accepted the application.
2. When a Contract for Accommodation has be concluded in accordance with the provisions of the preceding Paragraph, the Guest is requested to pay an accommodation deposit fixed by the Hotel within the limits of Basic Accommodation Charges covering the Guests, entire period of stay (3days worth when the period of stay exceeds 3 month).
3. About deposit, at first, the deposit shall be used for the Total Accommodation charges to be paid by Guest, at second, the Hotel pay back deposit to the Guest when the Guest pay accommodation charges under Article 6 and Article 18.
4. When the Guest has failed to pay the deposit by the date as stipulated in paragraph 2, the Hotel shall treat the Accommodation Contract as invailed. However, the same shall apply only in the case the Guest is informed by the Hotel when the period of payment of the deposit is specified.

Special Contracts Requiring No Accommodation Deposit

(Article 4) 1. Notwithstanding the provisions of Paragraph 2 of the preceding Article, the Hotel may agree to a special contract requiring no payment of the accommodation deposit after the contract has been concluded.
2. If, when accepting an application for an accommodation contract, the Hotel does not request payment of the deposit set forth in Paragraph 2 of the preceding Article or does not specify the due date for such payment, the Hotel shall be deemed to have agreed to the special contract described in the preceding Paragraph.

(Article 4) 1. Notwithstanding the provisions of Paragraph 2 of the preceding Article, the Hotel may enter into a special contract requiring no accommodation deposit after the Contract has been concluded as stipulated in the same Paragraph.
2. In the case when the Hotel has not requested the payment of the deposit as stipulated in Paragraph 2 of the preceding Article and/or has not specified the date of the payment of the deposit at the time the for an Accommodation Contract has been accepted a special contract prescribed in the preceding Paragraph.

Refusal of Accommodation

Refusal to conclude an accommodation contract

Article 5 (Refusal to Conclude an Accommodation Contract) / Refusal of Accommodation

(Article 5) The Hotel may refuse to conclude an accommodation contract in the following cases.

(Article 5) The hotel may not accept the conclusion of an Accommodation Contract under any of the following cases.

(1) When the application for accommodation does not conform to these Terms and Conditions.

(1)When the application for accommodation dose not conform with the provisions of these Terns and Conditions.

(2) When there are no rooms available due to full occupancy.

(2)When the Hotel is fully booked and no room is available.

(3) When it is deemed that there is a risk that the person seeking accommodation may engage in acts that violate the provisions of laws and regulations, public order, or good morals regarding accommodation.

(3)When the Guest seeking accommodation is deemed liable to conduct himself in a manner that will contravene the laws or good marals in regard to his accommodation.

(4) When a person intending to stay overnight is likely to cause a significant nuisance to other guests, or when the person engages in behavior that causes a significant nuisance to the guests.

(4)When the Guest seeking accommodation is deemed liable for misconduct and/or has condusted himself in a manner that will disturb the peace and comfort of other of the Hotel.

(5) When the person seeking accommodation is a member of an organized crime group, a member of an organized crime group, an organization related to an organized crime group, or a person affiliated with an organized crime group, or other anti-social forces.

(5)When the Guest seeking accommodation is a syndicate or belongs to an syndicate organization or is related to then or an antisocial group.

(6) When the person seeking accommodation is an organized crime group or a corporation or other organization whose business activities are controlled by organized crime group members.

(6)When the Guest seeking accommodation belongs to a syndicate or a corporation or a group that syndicate activities.

(7) When the person seeking accommodation is a corporation and one of its officers is a member of an organized crime group.

(7)When the Guest seeking accommodation belomgs to a coration that has syndicate as their executive.

(8) When a person seeking accommodation makes violent demands against the accommodation facility or accommodation facility staff, or demands a burden that exceeds a reasonable range.

(8)When the Guest seeking accommodation contracts a conducts a violent action or threats or requests to assume an unreasonable burden to the Hotel employees.

(9) When the person seeking accommodation is clearly recognized as a patient with an infectious disease.

(9)When the Guest seeking accommodation can be clearly detected as carrying an infectious disease.

(10) When accommodation is not possible due to natural disasters, facility failures, or other unavoidable reasons.

(10)When the Hotel is unable to provide accomodation due to natural calamities, disfuncstion of the facilities and/or other unavoidablecases.

(11) When the person seeking accommodation cannot be contacted after applying for accommodation.

(11)When the Guest seeking accommodation can not take communication.

(12) When a person intending to stay overnight allows a third party to stay in the room without permission, or when a third party uses the room for accommodation.

(12)When the Guest seeking accommodation another person stay without permission.

(13) When a person intending to stay overnight brings dangerous or heavy items.

(13)When the Guest seeking accommodation bring dangerous materials or heavy goods to the room.

(14) When any part of the accommodation is used as an organization, shop, office, or residence of an organized crime group, political organization, religious group, antisocial group, individual or other individual who may commit acts of violence regardless of name (hereinafter referred to as an "organized crime group"), or its members.

(14)The political association and the religious body that might doviolence, and an antisocial group and individuals.

(15) When a person intending to stay at the hotel engages in acts that cause discomfort, anxiety, fear, etc. to other guests, etc. by making the hotel a hangout for organized crime groups, or by having unscrupulous guests, etc. come in and out.

(15)When a collection place of the crime syndicate and a doubtful guest are put in the room or other stay guest are made to have an unpleassantness and uneasy time.

(16) When a person commits a crime, or is accused, accused, arrested, or charged as a person who has committed a crime. (Based on the provisions of Article 14 of the Fukui Prefecture Hotel Business Law Enforcement Ordinance.)

(16)When the person who committed a crime indicts, is accused or it arrested.

Article 6 (Guest's right to cancel the contract) / Right to Cancel Accommodation Contract

(Article 6) 1. The guest may cancel the accommodation contract by notifying the hotel.
2. If the Guest cancels all or part of the Accommodation Contract due to reasons attributable to the Guest (excluding cases where the Hotel specifies the payment date and requests payment of the application deposit pursuant to the provisions of Article 3, Paragraph 2, and the Guest cancels the Accommodation Contract before the payment), the Hotel will charge a penalty as listed in Attached Table 2.
However, in the event that the Hotel accepts the special agreement set forth in Article 4, Paragraph 1, this shall only apply when the Hotel notifies the Guest of the obligation to pay a penalty in the event the Guest cancels the accommodation contract.
3. If the guest does not arrive by 23:00 on the day of accommodation without contacting the hotel, the hotel may treat the accommodation contract as having been canceled by the guest.

(Article 6) 1.The Guest is entiled to cancel the Accommodation contract by so notifying the Hotel.
2.In the case when the Guest has canceled the Accommodation contract in whole or in part due to causes for which the Guest is liable (except in the case when the Hotel has requested the payment of the deposit during the specified period as prescribed in Paragraph 2 of Article 3 and the Guest prescribed has canceled before the payment), the Guest shall pay cancellation charges as listed in the Attached table No.2. However, in the case a special contract as prescribed Paragraph 1 of Article 4 has been concluded, the same shall apply only when the Guest is informed of the obligation of the payment of the cancellation charges in case of cancellation by the Guest.
3. In the case the Guest dose not appear by am 12 of the accommodation date or the Hotel may regard the Accommodation Contract as being canceled the Guest.

Right to Cancel Accommodation Contracts

Article 7 (Right to Cancel Accommodation Contracts of the Hotel) / Right to Cancel Accommodation Contracts

(Article 7) 1. The hotel may cancel the accommodation contract in the following cases.

(Article7) 1.The Hotel may cancel the Accommodation Contract under any of the following cases:

(1) When the Guest is deemed to be at risk of committing, or has committed, an act that violates the provisions of laws and regulations, public order, or good morals regarding accommodation.

(1)When the Guest is deemed liable to conduct and/or have conducted himself in a manner will contravene the laws or act against the public order of good morals in regard to his accommodation.

(2) When there is a risk of causing a significant nuisance to other guests, or when the Guest engages in behavior that causes a significant nuisance to other guests.

(2)When the Guest is deemed liable for misconduct and/or has and conducted himself in a manner that will disturb the peace comfort of other guests of the hotel.

(3) When the person is an organized crime group or a member of an organized crime group.

(3)When the Guest one of syndicate group or belongs to an organized group of syndicate.

(4) When the organized crime group or organized crime group member is a member of a corporation or other organization that controls business activities.

(4)When the Guest belongs to one of syndicate group or a corporation or a group that conducts syndicate activities.

(5) When a corporation has one of its officers who is a member of an organized crime group.

(5)When the Guest belongs to a corporation that has one of syndicate group as their excutive.

(6) When the person makes violent demands on the accommodation facility or the accommodation facility staff, or demands a burden that exceeds a reasonable range.

(6)When the Guest conducts a violent action or threats or requests to assume an unreasonable burden to the Hotel.

(7) When the guest is clearly recognized as having a contagious disease.

(7)A lodging Guest has been determined to ha been infected with a communicable disease.

(8) When accommodation is not possible due to reasons caused by force majeure such as natural disasters.

(8)When the Hotel is unable to provide accommodation due to natural calamities and/or other case of force measures.

(9) When the case falls under Article 14 of the Fukui Prefecture Hotel Business Enforcement Ordinance.

(9)When the provisions of Article 14 of Tokyo Metropolitan Ordinance are appliciable.

(10) When smoking while sleeping in the bedroom, tampering with firefighting equipment, etc., or not complying with any other prohibitions set forth by the Hotel's rules of use (limited to those necessary for fire prevention).

(10)When the Guest does not refrain from prohibited actions such as smoking in bed, mischief to the fire-fighting facilities and other prohibitions of the Use Regulations stipulated by the Hotel.

(11) When the person seeking accommodation cannot be contacted after applying for accommodation.

(11)When the Guest seeking accommodation can't contact the Hotel.

(12) When a person intending to stay overnight allows a third party to stay overnight or a third party uses the accommodation for accommodation.

(12)When the Guest seeking accommodation another person stay without permission.

(13) When a person intending to stay overnight brings dangerous or heavy items.

(13)When the Guest seeking accommodation bring dangerous materials or heavy goods to the room.

(14) When any part of the accommodation facility is used as a store, office, or residence by an organized crime group, political association, religious group, antisocial group, individual, or any other group or individual that is likely to commit violent acts (hereinafter referred to as an "organized crime group"), or its members.

(14)The political association and the religious body that might do violence, and an antisocial group and individuals.

(15) When a person seeking accommodation acts in a way that makes other guests feel uncomfortable, anxious, or fearful by making the property a hangout for organized crime groups or having suspicious guests come and go.

(15)When a collection place of the crime syndicate and a doubtful guest are put in the room or other stay guests are made to have an unpleasantness and uneasy time.

(16) When a person commits a crime, or is accused, accused, arrested, or prosecuted as a person who has committed a crime.

(16)When the person committed a crime indicts is accused.

2. When the hotel cancels the accommodation contract based on the provisions of the preceding paragraph, the guest will not be charged for accommodation services, etc. that have not yet been provided to the guest.

2. In the case the hotel has canceled the Accommodation Contract in acc-ordance with the preceding Paraph, the Hotel shall not be entitled to charge the Guest for any of the services in the future of the contractual period which he has not received.

Article 8 (Registration of accommodation) / Registration

(Article 8) 1. Guests must register the following information at the front desk of our hotel on the day of their stay.

(Article 8).1.The Guest shall register the following particulars at the Front Desk of the Hotel on the day of accommodation.

(1) Name, age, gender, address and occupation of the guest

(2) For foreigners, nationality, passport number, place of entry, and date of entry

2. If the Guest intends to pay the charges set forth in Article 12 using a traveler's check, accommodation voucher, electronic money, or other method that can replace currency such as a credit card, he/she must present these in advance at the time of registration as set forth in the preceding paragraph.

2.In the case the Guest intends to pay his Accommodation Charges Prescribe in Article12 by any means other than Japanese currency, such as traveller's check coupons or credit cards, these credentials shall be shown in advance at the time of the registration prescribed in the preceding paragraph.

Guest Room Use / Charges / Regulations

Room usage, usage rules, and fee payment

Article 9 (Occupacy Hours of Guest Rooms)

(Article 9) 1. The guest may use the hotel's guest rooms from 3:00 p.m. on the day of arrival to 11:00 a.m. the next day.

(Article 9) 1. The Guest entitled to occupy the contracted guest room of the Hotel from 2:00pm to 11:00am the next morning.

However, if you stay for consecutive nights, you can use it all day except for the day of arrival and the day of departure.

However, in the case the guest is accommodated continuously, the Guest may occupy it all day long, except for the days arrival and departure.

2.Notwithstanding the provisions of the preceding paragraph, the hotel may accept use of guest rooms outside of the hours specified in the same paragraph. In this case, the following additional charges will be charged.

2. The Hotel may, notwithstanding the provisions prescribed in the preceding Paragraph, permit the Guest to occupy the room beyond the time prescribed in the same Paragraph. In this case, extra charges shall be paid as follows:

Article 10 (Observance of Use Regulations)

(Article 10) Guests must abide by the usage rules established by the hotel and posted within the hotel while inside the hotel.
(Article 10). 1.The Guest shall observe the use Regulations established by the Hotel, which are posted within the premises of the Hotel.

Article 11 (Business hours)

(Article 11) 1. The business hours of the hotel's main facilities, etc. are as follows, and detailed business hours of other facilities, etc. will be announced in the provided pamphlets, notices in various places, service information in guest rooms, etc.
(Article 11). 1. The business hours of the main facilities, etc. of the Hotel are as follows, and those of other facilities, etc. shall be noticed in detail by brochures as provided, notices displayed in each place, service in guest rooms and other.

2. The time stated in the preceding paragraph may be changed temporarily if necessary. In that case, we will notify you by an appropriate method.
2.The business hours specified in the preceding Paragraph are subject to temporary charges due to unavoidable cause of the Hotel. In such a case, the Guest shall be informed by appropriate means.

Article 12 (Payment of Accommodation Charges)

(Article 12) 1. The details of the accommodation charges, etc. to be paid by the guest and the method of calculation thereof are as listed in Attached Table 1.
(Article 12). 1.The breakdown and method of calculation of the Accommodation Charge, etc that the Guest shall pay is as listed in the Attached Table No.1.

2.Payment of the accommodation fee set forth in the preceding paragraph shall be made in currency or by alternative methods approved by the Hotel, such as traveler's checks, accommodation coupons, credit cards, etc., at the front desk upon the Guest's arrival or upon request by the Hotel.
2.Accommodation Charges, etc as stated in the preceding Paragraph shall be paid with Japanese currency or be any means other than Japanese currency such as traveller's check or credit cards recognized by the Hotel at the Front Desk at the time on the arrival of the Guest or upon request by the Hotel.

3. Even if the hotel provides a guest room to the guest and the guest voluntarily chooses not to stay in the room after the guest is able to use the room, the accommodation fee will still be charged.
3. Accommodation Charges shall be paid, even if the Guest voluntarily does not utilize the accommodation facilities provided for him by Hotel and are at his disposal.

Liabilities and Handling of Property

Our hotel's responsibilities, deposited items, and baggage handling

Article 13 (Liabilities of the Hotel)

(Article 13) 1. If the Hotel causes damage to the Guest in the performance of the Accommodation Terms and related contracts or due to non-performance thereof, the Hotel will compensate the Guest for such damage. However, this does not apply if the damage is not due to reasons attributable to the hotel.
(Article 13).1.The Hotel shall compensate the Guest for the Hotel has caused such damage to Guest in the fulfillment or the nonfulfillment of the Accommodation Contract or related agreements. However, the same shall not apply in the case when such damage has beencaused due to re-ason for which the Hotel is not liable.

2. Although our hotel has been certified as a special facility by the fire department, we have taken out liability insurance to deal with the unlikely event of a fire.
2.The Hotel is insured by Hotel Liability Insurance covering matters arising in case of fire or other emergencies.

Article 14 (Handling when unable to provide Contracted Rooms)

(Article 14) 1. If the hotel is unable to provide the guest with the contracted room, the hotel shall, with the consent of the guest, arrange for another accommodation facility with the same conditions as possible.
(Article 14) 1. The Hotel shall, when the Hotel can not provide contracted rooms, arrange accommodation of the same standard elsewherefor the Guest in so far as it is pra-cticable with the consent of the Guest.

2. Notwithstanding the provisions of the preceding paragraph, if the hotel is unable to arrange other accommodations, the hotel will pay the guest an amount equivalent to the reserved room charge as compensation. However, if there is no reason attributable to the hotel, such as a natural disaster or disaster, we will not pay compensation for the inability to provide a guest room.
2.When it can not introduce other accommodation, this hotel pays the same amount of money as the reserved hotel charge. However, it is not possible to pay when there is no responsi-bility of the hotel like the disaster, etc.

Article 15 (Handling of Deposited Articles)

(Article 15) 1. The hotel will only be responsible for loss or damage to the guest's belongings if the loss or damage is due to intentional or gross negligence on the part of the hotel. If the hotel compensates for the damage, it will be compensated within the scope of the inn's general liability insurance.
(Article 15) 1. It pays a claim when disappering or damaging it because of the guest's mistake.However, we will pay within the range of the inn integration compensation insurance.

2. We do not accept valuables such as money, negotiable securities, jewelry, or important documents. Therefore, guests are responsible for managing their valuables during their stay.

Article 16 (Custody of Baggage and/or Belongings of the Guest)

(Article 16) 1. If the guest's baggage arrives at the hotel prior to his or her stay, the hotel will take responsibility for storing the baggage and hand it over to the guest when checking in at the front desk only if the hotel agrees to do so prior to the guest's arrival.
(Article 16) 1.When the Baggage of the Guest is brought into the Hotel before his arrival, the Hotel shall be liable to keep it only in the case such a request has been accepted by the Hotel. The baggage shall be handed over to the Guest at the Front Desk at the time of his check-in.

2. If the Guest's baggage or personal effects are left behind at the Hotel after the Guest has checked out, and the owner is identified, the Hotel shall contact the owner and request instructions. However, if there is no instruction from the owner or if the owner cannot be identified, the item will be kept for 7 days including the date of discovery and then delivered to the nearest police station.
2.When the baggage or belongings of the Guest is found left after his check-out, and the ownership of the article is confirmed, the Hotel shall inform the owner of the article left and ask for further instructions. When no instructions is given to the Hotel by owner or when the ownership is not confirmed, the Hotel shall keep the article for 7days including the day it is found, and after this period, the Hotel shall turn it over to the nearest police station.

3. The hotel's responsibility for the storage of the Guest's baggage or personal belongings in the cases referred to in the preceding two paragraphs shall be in accordance with the provisions of Paragraph 1 of the preceding Article in the case of Paragraph 1, and in accordance with the provisions of Paragraph 2 of the same Article in the case of the preceding Paragraph.
3.The Hotel's liability in regard to the custody of the Guests baggage and belongings in the case of the preceding two paragraphs shall be assumed in accordance with the provisions of Paragraph2 of the same Article in the case of Paragraph 2

Article 17 (Liability of the Guest)

(Article 17) If the Hotel suffers damage due to the Guest's intention or negligence, the Guest shall compensate the Hotel for the damage.
(Article 17) 1. The Guest shall compensate the Hotel for the damage caused through intention or negligence on the part of the Guest.

(Note)
1. % is the ratio of the penalty fee to the basic accommodation fee.
2. If the contract date is shortened, a penalty fee of one day (first day) will be collected regardless of the shortened date.

Remarks:
